Terms of Service

1. Who we are, and who may use the service

Sherlock Health, Inc. (“Sherlock Health,” “we”) operates JointVoyage and OpenDoc. JointVoyage is operated independently of any surgical practice. The service is offered to adults, 18 or older, in the United States. By using it you confirm that you are, and that any information you enter about yourself is yours to enter.

2. What JointVoyage is, and is not

JointVoyage offers education and decision guidance for people deciding about, preparing for, and recovering from hip or knee replacement. It is not a medical practice, it does not diagnose anyone, and using it does not create a physician-patient relationship with Sherlock Health. Nothing on the site is medical advice, and it never replaces an examination by a clinician who can see you.

• A Fit Score states what your answers and evidence support and names what is missing. It is a descriptive summary, not a verdict, not a prediction of your outcome, and not an eligibility decision. Its weights are assigned, not derived from outcomes, and it is under validation.
• A Readiness Score counts preparation work done. It never subtracts for your health. “Ready for Surgery” is completion of the preparation pathway confirmed by a surgical team; it is not medical clearance.
• A Recovery Score is a trend drawn from your own earlier check-ins. It is not a validated outcome measure and never overrides a safety concern.
• The site is not emergency care and provides no monitoring. Sudden shortness of breath, chest pain, fainting, or any emergency means calling emergency services, not using this site.

Every decision about your care stays with you and the clinicians who treat you.

3. Your record and your sign-in

A record is created only when you sign in with a one-time code sent to your phone or email. Keep that phone and that mailbox secure; anyone who can read them can sign in as you. Tell us at privacy@sherlockhealth.ai if you believe your record has been reached by someone else.

Your record is yours. Nothing in it reaches a clinician unless you authorize that clinician by name, and you can withdraw an authorization at any time. A clinician keeps a copy of anything they signed while it was in force. Our privacy policy says what we collect, how it is used, and how to have it deleted.

4. Clinician services

A written second opinion, a surgery request, and any other service from a surgeon on JointVoyage is provided by that surgeon, an independent licensed physician, under their own name and their own professional responsibility. Sherlock Health is the platform on which the request is made and the report is delivered; it does not practice medicine and does not supervise the surgeon’s judgment.

• The surgeon sets the price. Payment is collected by OpenDoc under OpenDoc’s terms, which also govern refunds. The price shown is the price charged; there is no other fee from us.
• A written opinion is a review of the records and images you provide. It is not a visit, an examination, or a consultation, it orders and changes nothing about your current treatment, and it gives you no place, priority or access with the surgeon or anyone else. Whether the surgeon would see you is the surgeon’s own statement, and any care after that is arranged between you and them.
• Which surgeons may provide a service to you depends on the state you live in and on Medicare rules, and a service may be unavailable to you for those reasons. The site says why when it is.
• A surgery request is a request, not a booked operation. The surgeon must review your case, meet you, and complete informed consent before anything is scheduled.

5. For physicians

A physician account is for a licensed physician acting in their own name. We verify identity before any patient information is shown, and you agree to give us accurate information for that. You may use a patient’s information only for that patient and only within the authorization they gave, and you are responsible for your own clinical judgment, licensure, and the obligations that attach to what you sign. JointVoyage is a consumer health app: what a patient shows you here was authorized to you by that patient, and what you write and keep is held under your own professional and legal obligations, including HIPAA where it applies to you. A correction you make to your public record is published as your own statement, beside what the public sources show.

6. Text messages

Signing in with a phone number means we may text that number with sign-in codes and the notifications your record generates, at most one notification a day, with no health information in any of them unless you separately consent to a medication reminder that names the medication. Reply STOP to stop all texts, START to resume, HELP for help. Message and data rates may apply.

7. Surgeon record pages

The pages at /surgeons are documented records compiled from public sources, each fact carrying its source and the date it was read. They are not ratings, rankings or recommendations, and listing a surgeon is not an endorsement by us or by any organization named as a source. A fact nobody has documented reads “not yet documented,” which is a gap in the record and never a finding about the surgeon. A physician may correct their own page after verification or ask for it to come down; anyone may report an error from the page. A report is a claim; the page changes only when a person has checked it against a source.

8. What you agree not to do

• Enter another person’s information as your own, or without their authority.
• Sign in as, or hold yourself out as, someone you are not, including a physician.
• File a report about a surgeon record you know to be false.
• Scrape, copy or republish the surgeon records or the education pages in bulk, or use them to build a competing directory.
• Probe, overload or interfere with the service, or try to reach information you are not authorized to see.

9. Content and intellectual property

The education pages, the scores, their names, and the site’s design are ours or licensed to us. You may read and print them for your own use and share links to them. What you enter into your record remains yours; you give us permission to store and process it to provide the service, as the privacy policy describes. Sources cited on a page belong to their publishers.

10. No warranty

The service is provided as it is and as it is available. Education pages describe what studies report about populations, are checked against their sources on the date each page states, and may be out of date. Scores are descriptive and under validation. We make no warranty that the service is accurate, complete, uninterrupted or fit for a particular purpose, and we disclaim all warranties to the extent the law allows.

11. Limitation of liability

To the extent the law allows, Sherlock Health is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits, arising from the service, and our total liability for any claim arising from the service is limited to the greater of one hundred dollars or the amount you paid to Sherlock Health in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for our own fraud or gross negligence, or excludes a right the law gives you that cannot be excluded.

12. Indemnity

You agree to indemnify Sherlock Health against claims arising from your breach of these terms or your unlawful use of the service.

13. Governing law and disputes

These terms are governed by the law of the State of Delaware, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction. Before filing, write to us at privacy@sherlockhealth.ai; most concerns can be resolved directly.

14. Ending the agreement, and changes to it

You may stop using the service at any time and ask us to delete your record. We may suspend or end access for a breach of these terms. When these terms change, the effective date moves and the change is recorded in the site’s changelog; continuing to use the service after that date means accepting the change. If any part of these terms is found unenforceable, the rest stands. These terms and the privacy policy are the whole agreement between you and Sherlock Health about JointVoyage.
